Frequently Asked Questions (FAQs)

If I Can’t Pay My Taxes, Should I File Anyway?

Absolutely. It is a crime not to file your tax returns. Plus, even if you don’t file, penalties will be applied retroactively when you do file. The IRS can also file taxes for you through there Substitute for Return (SFR) program, often resulting in an inflated amount due. If you can’t afford to pay your taxes, there are always options such as an installment agreement or offer in compromise.

Why Am I Being Audited?

There are a few different reasons your tax return has been selected for audit. But odds are, it’s because something looks out of place with your return. When you file your return, the IRS compares it with similar returns. If something looks out of place, you are more likely to be audited. For instance, if your advertising expense is triple what other similar businesses with similar gross receipts are spending, you are more likely to be audited.

Will a Filed IRS Lien Impact My Credit?

Definitely. If the IRS files a lien, expect your credit to take a significant hit. It could be as drastic as a couple hundred points. But if you settle the liability or enter into certain types of installment agreements, the IRS will release the liens. Of course, you can always pay it in full, in which case the IRS will also release the lien.

What is FACTA?

FACTA is the Foreign Account Tax Compliance Act. It requires foreign certain foreign entities to report to the U.S. government about U.S. foreign asset holders. If you are caught not properly reporting your foreign assets, there are severe criminal and civil penalties. Many taxpayers are in the dark about the requirements and do not even know they are violating federal law. Fortunately, you have options to disclose foreign accounts to limit criminal and civil penalties.

Will the IRS Come to My House or Business?

Maybe. If you’ve ignored IRS notices, the IRS may try to reach you in person. This could mean a knock on your door at your home or business by an IRS Revenue Officer or Revenue Agent. If they catch you by surprise, it’s usually best to take their card and politely request an opportunity to consult with an attorney. Even if you think you’ve done nothing wrong, it’s always best to consult with an attorney about your potential exposure.
